The Odessa-Montour Sports Boosters are dedicated to providing support and opportunities to the athletes at Odessa-Montour Central School. With that in mind we have a set up by-laws that are followed by each member and officer.


BY-LAWS

ARTICLE I - NAME

Section 1

The name of this organization shall be the Odessa-Montour Sports Boosters (OMSB).

ARTICLE II - CHARTER & PURPOSE

Section 1: Association

The OMSB is a voluntary, not-for-profit association of individuals, organized to support, promote, and encourage the student athletes and athletic programs of the Odessa-Montour Middle and High School. An Athletic Program is a team or club that is competing interscholastically.

  1. The eligibility for financial, physical and emotional support for which the OMSB provide will include clubs or teams who are involved in the O-M Athletic programs.  Consideration for said support will be given with the entire team/club in mind.

  2. Not withstanding any other provision of these Articles, this organization shall not carry on any activities not permitted to be carried on by an organization exempt from Federal Income Tax under Section 501(c)(3) of the Internal Revenue Code of 1986 or the corresponding provision of any future United States Internal Revenue Law.

  3. No part of the activities of the OMSB  shall be carrying on propaganda, or otherwise attempting to influence legislation, or participating in, or intervening in (including the publication or distribution of statements), any political campaign on behalf of any candidate for public office.

Section 2: Financial

Financial contributions may be provided, when requested in writing (and preferably in person) or when a need is perceived, to athletic programs for the purpose of purchasing necessary equipment or upgrading existing facilities. It is not the intent of the Boosters to provide items for personal use for team or coaching personnel (i.e. items must be necessary for participating in the sport).

All major purchases of boosters’ equipment over $100 must be approved by the majority vote of the general active membership but must also have at majority vote of the officers. 

Section 3: Contributions

Upon agreement of the voting membership, contributions may be provided for support during special and unusual team events to help defray the expenses of travel, lodging or meals.

Section 4: Athletic Functions

The OMSB, upon agreement of the voting membership, may provide contributions for awards, prizes and gifts to special school functions related to the programs. The OMSB is responsible for financial support of these activities, but does not determine the awardees or when the awards are done. The Athletic Director is responsible for organizing and announcing the date. Such functions shall include but not limited to the following:  

  1. Award Ceremonies;

  2. Graduation or Class activities;

  3. Homecoming Activities;

  4. Banquets;

  5. Hall of Fame: Purchasing plaques for up to 4 awards can be financially supported for this award; however the number of nominees may be flexible and can be voted on depending on funds available;  

  6. STAR Award (Sports Team Athletic Recognition): varsity sport award, 1 award per season, per varsity sport (5-Fall, 7-Winter, 6-Spring).

Section 5: Financial Support

The OMSB, upon agreement of the voting membership, may provide financial support towards the purchase of team appearance items which represent Odessa-Montour Middle School and Odessa-Montour High School . Guidance for the expenditure of this financial support is provided as follows:

  1. The Boosters will provide the fair market value for the purchase of a State Championship jacket or ring, if said team or individual wins a state event. Athletes eligible to receive a jacket or ring will be determined by the voting membership with the guidance of the Athletic Director and the coaching staff;

  2. Repeat State Champions will be eligible for a repeat jacket or ring;

  3. Team sweaters, warm-ups and gym traveling bags, are examples of items to be considered under this provision. Such items would be the property of the O-M Athletic Department and shall remain the responsibility of the Athletic Director and the coaching staff.

ARTICLE III - MEMBERSHIP

Section 1: Participation

Any person interested in promoting the OMSB may become a voting member of the OMSB by participating in Booster activities.

Section 2: Categories of Membership

Active/voting--individuals who have participated in Booster activities within the current school year, September through June. Inactive--individuals who have participated in Booster activities but are not currently active.

Section 3: Changes in Categories

The officers may establish categories of membership other than those described in Article II, Section 2.

ARTICLE IV - MEETINGS

Section 1: Annual Meeting

The Annual Meeting will be held the first Wednesday in the month of May. During that meeting the nomination  of Officers for the upcoming school year will take place.

Section 2: Monthly Meeting

The date of the regular monthly meeting is the first Wednesday of each month for the transaction of monthly Booster business. The officers may change the dates of the regular meetings in order to meet the needs of the organization.

Section 3: Special Meetings

Special meetings may be called by any of the officers.

Section 4: Meeting Notice

Notice of meetings shall be emailed to all members and coaches and posted on the Booster website: www.omsportsboosters.com at the earliest convenience.

Section 5: Meeting Cancellations

Should a meeting date fall on a day when school is canceled, the meeting will be postponed until the next regular monthly meeting, or, if rescheduling is necessary, will be determined by the officers. Notices of postponement will be announced by email and posted on the Booster’s website.

ARTICLE V - DUTIES OF THE OFFICERS

All officers must be nominated and elected to their respective positions no later than June of the previous school year. This allows incoming officers and committee chairs to take advantage of the outgoing officers’ expertise in preparation for the fall sports season.

Incoming officers and any appointed committee chairpersons shall attend the June Booster meeting and assume the duties and responsibilities in July.

Outgoing officers will provide an information notebook (continuity folder) with positions descriptions, required tasks, points of contact and estimated time lines to pass on to their successors.

Section 1: Elected Positions

The Officers of the OMSB shall be:  the two Co-Presidents, Secretary and Treasurer.  If an officer is not fulfilling his/her duties as described below, the membership may elect to replace the person in that position. A motion to removing an officer must be passed by a 2/3rd majority vote at a regular membership meeting.

The Co-Presidents shall:

Preside at all general membership and meetings.

  1. Appoint special committees, both chairman and members, as deemed necessary to assist in the conduct of OMSB affairs.

  2. Serve as advisor to all committees.

  3. Negotiate and sign all contracts, obligations, and instruments of the OMSB in the normal conduct of business.

  4. Act as the central focal point for all requests of the OMSB. Identify general tasks needed to accommodate the request and if needed, delegate the task to a committee member most suited to the request.

  5. Act as facilitator for all officer discussions and implement proper parliamentary procedures for all votes.

  6. Shall attempt to have an OMSB member present at all team meetings to discuss OMSB activities.

  7. Review by-laws annually. Chair a by-law committee if extensive changes are required. Present all needed or requested changes to the OMSB Officers.

  8. Must receive and review all bank financial statements that are received directly from the bank to one of the Co-presidents.

 The Secretary shall:

  1. Record the minutes of all meetings.

  2. Maintain a roster of all officers.

  3. Provide a sign-in sheet at each meeting.

  4. Provide copies of the minutes of the previous meeting as well as maintain a permanent record of all general meetings. E-mail minutes to those OMSB members with an active e-mail account.

  5. Prepare appropriate OMSB correspondence with the exception of individual committee correspondence as directed by the President.

  6. Maintain the master copy of current and historical by-laws of the OMSB.

  7. Maintain a record of all individual committee reports.

The Treasurer shall:

  1. Oversee all deposits and withdrawals as per our audit procedures.

  2. Maintain an accurate accounting of said funds.

  3. Disperse funds as approved by the OMSB officers.

  4. Prepare and present a financial statement concerning the solvency of the OMSB at each general business meeting.

  5. Prepare and present an in-depth financial statement concerning the solvency of the OMSB at the first annual meeting of the general membership concerning the previous school year. The report shall be available to the membership on request.

  6. Review cash control procedures and present to the OMSB  for approval in May of each year.

  7. Prepare the books for audit annually within thirty (30) days after close of school year (June 30th). If leaving office during a school year, prepare books for audit 30 days prior to leaving office.

  8. Must receive and review all bank financial statements that are received directly from the bank

Section 2: Eligibility

An Officer must be a resident of the school district.  They may also be any persons who teaches and/or is employed by the OMCS district.

Section 3: Term

The Officers shall be elected for a one year term.  They must be nominated for a second term.  No officer shall serve more than two consecutive terms in one position.  Due to the lack of volunteers and members, this may be overturned by active boosters.

Section 4: Election

Election of Officers shall be by nomination, seconded and accepted by the nominee at the annual meeting in May.

Section 5: Resignations and Vacancies

When a vacancy exists, the office may be filled by a majority vote of the voting membership present at the next Booster meeting. These vacancies will be filled only to the end of the current term in June.

Section 6: Powers of Officers

The officers with the consent of a simple majority of the membership present, shall have all the powers of an Executive Board, and shall have the entire management and control of Booster property, and shall exercise general superintendence over all affairs of the OMSB. The Officers shall have power to make all necessary contracts and expenditures.

ARTICLE VI - AMENDMENTS

Section 1: By-Laws

These By-laws may be amended when necessary by a two-thirds majority of the voting membership. Proposed amendments must be submitted in writing, to the voting membership at a regular meeting. Copies of the proposed changes will be available from the President and Secretary and published on the Booster website the month prior to the second vote. The changes must be approved by two thirds of the voting membership at two consecutive regular meetings.
